Is Our Justice System Broken: Bondholder Rep Weighs In

After spending 13 years in the US Federal Bankruptcy Court as a bondholder representative, it has become obvious that truth and justice are no longer the primary objectives of our court system.

The current US legal system permits and encourages unscrupulous attorneys to argue any side of any issue regardless of the actual facts in the case. It also allows unlimited and sometimes intentionally distracting motions or requests for adjournments that are not only permitted but never punished. There is no punishment for attorneys who make careers manipulating the system. Thus, I fear that far too often money rather than actual facts determines court outcomes.

A further hindrance in our search for truth and justice is the desire of many judges to have parties reach a settlement rather than a conclusion. Sadly, this situation results in truths that are never acknowledged, falsehoods viewed as valid. When time is money to all concerned, money trumps truth every time.

After expending all available funds (in excess of $1.6 million) set-aside in a confirmed Chapter 11 Bankruptcy Reorganization, we bondholders and secured creditors were forced to acknowledge that for us there would be no justice! We could no longer afford to continue to Appeal to refute the intentional misrepresentations.

About the Book: "License to Steal":

Ray W. Rowney, Jr. experiences the departure of truth and justice from the U.S. legal system in his firebrand expose License to Steal. He methodically chronicles the various legal procedures and policies that can be manipulated to aid and support fraud. He then draws striking comparisons to the current performance of the federal government, wherein spin has also replaced facts and truth. He laments a legal system and federal government that encourage greed in all Americans. Read more about this book.
