After spending 13 years in the US Federal Bankruptcy Court as a bondholder representative, it has become obvious that truth and justice are no longer the primary objectives of our court system.
The current US legal system permits and encourages unscrupulous attorneys to argue any side of any issue regardless of the actual facts in the case. It also allows unlimited and sometimes intentionally distracting motions or requests for adjournments that are not only permitted but never punished. There is no punishment for attorneys who make careers manipulating the system. Thus, I fear that far too often money rather than actual facts determines court outcomes.
A further hindrance in our search for truth and justice is the desire of many judges to have parties reach a settlement rather than a conclusion. Sadly, this situation results in truths that are never acknowledged, falsehoods viewed as valid. When time is money to all concerned, money trumps truth every time.
After expending all available funds (in excess of $1.6 million) set-aside in a confirmed Chapter 11 Bankruptcy Reorganization, we bondholders and secured creditors were forced to acknowledge that for us there would be no justice! We could no longer afford to continue to Appeal to refute the intentional misrepresentations.
